This Privacy Policy (this “Policy”, “Privacy Policy”) applies to Polls for Pages, Quizzes for Pages, Surveys for Pages and Contests for Pages (the “Apps”) operated by Code Rubik inc. (“we”, “our”, “us”) and serves to inform users of the Apps (“you”, “your”) of how we collect, manage and use personal information, and to obtain your consent with respect to the collection, use and disclosure of your personal information.

By using the Apps, you give us express consent to collect, use, store and disclose your personal information as indicated in this Privacy Policy. If you do not wish to give such consent, stop using the Apps immediately.

How the Apps Work

The Apps may be used by two types of users: promoters and participants.

Promoters create and manage polls, quizzes and contests, gather answers or entries from participants and have control on such answers or entries.

Participants provide promoters with answers or entries for particular polls, quizzes or contests.

Unless a distinction is indicated, this Policy applies to both promoters and participants.

Promoters may collect personal information through the Apps. They commit to using personal information in accordance with applicable laws and regulations but we do not monitor promoters’ practices and take no responsibility for any use or disclosure of personal information by promoters.

Information We Collect

We collect basic public information about your Facebook account, such as your name, gender, Facebook ID and email address, when you create an account with us.

We collect information you provide to us by email or via Facebook when you contact us.

We automatically collect browsing information when you use the Apps, such as your IP address, your operating system, the configuration of your browser or mobile device. This information is not associated with your identity unless you created an account with us or provided a promoter with access to your Facebook account.

Promoters collect basic public information about your Facebook account, such as name, gender, Facebook ID and email address when participants provide answers or entries other than anonymously. They may collect additional personal information when participants provide answers or entries to promoters through the Apps, depending of the nature of offered polls, quizzes or contests. Our role with respect to any such additional personal information collected is limited to holding said information for its use by promoters.

Promoters may offer polls, quizzes or contests without disclosing their identities. Participants should be aware that any personal information they provide through the Apps may be collected and retained by promoters, even after a promoter’s account is deleted.

Cookies

The Apps use cookies to personalize content and user experience. Cookies are small files that are stored on your computer by the server hosting the Apps. They mostly consist of an identifier that serves to keep track of your current session and the interactions your computer has had with the Apps.

Use of Personal Information

We use your personal information to contact you about our services and respond to your enquiries.

We DO NOT (i) use personal information for any other purpose than to provide our services to promoters and participants, (ii) sell personal information, (iii) share personal information with other entities, except as provided in this Policy.

We use information collected automatically on an aggregated basis in order to improve the Apps, develop new features and monitor Apps use.

Promoters may use personal information provided by participants in accordance with their own policies. As a participant, you should review any such available policy before submitting personal information using the Apps. We do not monitor the use of personal information gathered through the Apps by promoters or third-parties. If you provide personal information to a promoter through the Apps, you do so at your own risk, we disclaim all responsibility for any personal information use or disclosure performed by a promoter or third-party.

Disclosure of Personal Information

We will disclose personal information only to the employees, officers or directors of Code Rubik that need to access such information to perform their duties. We may also disclose personal information to suppliers, contractors, consultants or other entities assisting us in the conduct of our business, provided they pledge to keep such information confidential and to the extent that access to such information is necessary in order for said person or entity to perform its obligations towards us.

In the event of a prospected sale or transfer of part of whole of our business to a third-party (a “prospective transaction”). We reserve the right to disclose personal information to a potential acquirer either before or after the prospective transaction, to the extent that personal information is relevant to the prospective transaction and that any person or entity to which personal information is disclosed commits to comply with this Privacy Policy.

Other than as set forth in this Privacy Policy, we may disclose personal information without your express consent only where (i) the law explicitly allows such disclosure, or (ii) we are compelled to do so by a competent authority.

Storage of Personal Information

We store personal information on virtual servers using Heroku. Physical servers are located in North Virginia, USA. Their location may change from time to time but personal information will always be stored within the United States of America. We maintain constant access to information stored on our virtual servers, and personal information is protected with the same security measures as our own confidential information.

Access to Your Information

You may ask us to access any personal information we hold about you and ask that any error be corrected or such information removed. We will comply with written requests from individuals who are registered with an account to use our services within a reasonable delay, in any case a maximum of thirty (30) days after receipt of a request. We may verify the identity of individuals seeking to access personal information.

You must include with your request:

  1. The name of each relevant App;
  2. Your User ID for each relevant account;
  3. Your full name and email address;

As a participant, it may not be possible to retrieve all personal information we may hold about you. Promoters control information gathered via their polls, quizzes or contests and they may remove some information from our database or render it impossible to effectively retrieve.

Removal of information from our servers will render such information unavailable to us or any third-party, but we cannot guarantee that removed information will be impossible to retrieve.

We respect laws and regulations governing the transmission of commercial electronic messages. If you are unhappy with our email communication practices or wish to stop receiving email messages from us, please contact us at the following address: privacy@coderubik.com.

Governing Law

This Privacy Policy and the rights and obligations created thereby shall be governed by, interpreted and enforced in accordance with, the laws in the Province of Quebec and the laws of Canada, as applicable.

Modifications

We may modify this Privacy Policy from time to time in order to reflect changes in the way we manage personal information. In such case, a modified policy will be available through our website, and the posting of the new policy will serve as a notice to you. The date of the last update is indicated above.
